Welcome to middletonfoodpantry.org (the “Site”), operated by Middleton Food Pantry, Inc (“we,” “us,” or “our”). By accessing or using the Site, you agree to these Terms of Service (the “Terms”). If you do not agree, do not use the Site.

1) User Content (Reviews, Photos, Social Tags)
When you submit content (e.g., reviews/ratings, social media tags):
You grant us a worldwide, royalty‑free, perpetual license to use, reproduce, modify, display, and distribute that content in any media for marketing or other purposes.
You represent you own or have rights to the content and that it does not infringe, defame, or violate any law or third‑party right. We may moderate or remove content at our discretion.
2) Acceptable Use
You agree not to:
use the Site for unlawful purposes; attempt to interfere with the Site’s security or integrity; harvest data or scrape content without permission; misrepresent your identity or affiliation without our written approval).
3) Intellectual Property
All content on the Site—text, photos, graphics, logos (with the exception of our partner's logos)—is owned by or licensed to Middleton Food Pantry, Inc and protected by law. You may not use our intellectual property without prior written permission.
4) Third‑Party Links & Tools
The Site may link to third‑party sites or tools we do not control. We are not responsible for their content or practices. Use at your own risk and review their terms and policies.
5) DMCA / Copyright Policy
If you believe content on the Site infringes your copyright, send a notice with: (1) your contact info, (2) identification of the work claimed infringed, (3) identification of the material to be removed, (4) a good‑faith statement, and (5) a statement under penalty of perjury that you are authorized to act, to MFP_idaho@yahoo.com. We may remove content and terminate repeat infringers.
6) Warranties & Disclaimers
The Site and all content/services are provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title, or non‑infringement. To the fullest extent permitted by law, we do not guarantee uninterrupted, error‑free, or secure operation of the Site.
7) Limitation of Liability
To the maximum extent permitted by law, Middleton Food Pantry, Inc and its owners, volunteers, employees, and agents shall not be liable for any indirect, incidental, consequential, special, or punitive damages, or for lost profits or revenues, arising from or related to your use of the Site, even if advised of the possibility. Our aggregate liability for any claim shall not exceed the amount you paid for the content or service at issue in the 12 months preceding the claim.
8) Indemnification
You agree to defend, indemnify, and hold harmless Middleton Food Pantry, Inc and our owners, volunteers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site, your breach of these Terms, or your violation of any law or third‑party right.
9) Dispute Resolution; Arbitration; Class Action Waiver (U.S.)

Informal Resolution. Contact us first to attempt to resolve any dispute.
Binding Arbitration. Except for small‑claims matters or claims for injunctive relief, any dispute between you and us relating to these Terms or the Site/products will be resolved by binding arbitration under the AAA Consumer Arbitration Rules. Arbitration will be conducted by a single arbitrator, and may be held by phone/video or on written submissions.
Class Action Waiver. You and Middleton Food Pantry, Inc agree that each may bring claims only in your/its individual capacity, and not as a plaintiff or class member in any putative class or representative proceeding. The arbitrator may not consolidate claims of more than one person.
Opt‑Out. You may opt out of arbitration/class waiver by sending written notice to MFP_idaho@yahoo.com within 30 days of your first use of the Site after the date these Terms took effect for you.
Governing Law & Venue. These Terms are governed by the laws of the State of Idaho, without regard to conflict of laws. For claims not subject to arbitration (e.g., small claims), the exclusive venue shall be the state or federal courts located in Canyon County, Idaho.
10) Termination
We may suspend or terminate access to the Site or any account at any time for any reason, including if we believe you violated these Terms or applicable law.
11) Changes to the Site or Terms
We may update the Site and these Terms from time to time. The “Last updated” date reflects the latest revision. Continued use after changes means you accept the updated Terms.
